Terms & Conditions
All products and services of MammaFit and its subsidiaries and affiliates are subject to the terms and conditions of the applicable agreements governing their use. The Terms are to be read by you together with any terms, conditions or disclaimers provided in the pages of the Site. In the event of any conflict, the terms provided in the pages of the Site will govern. The information, material and content provided in the pages of the Site (the “Information”) may be changed at any time without notice. Changes may be made to the Terms at any time without notice by updating this posting. You agree to review the Terms regularly and your continued access or use of the Site will mean that you agree to any changes.
If your scheduling conflict is known in advance and we are notified at least 24 hours ahead of time, it maybe possible to make the session up at a later date. However, this cannot be guaranteed. Any sessions missed with less than 1 hours notification are forfeited. If you have not already paid for the session, your account/card will be charged for the full amount of the session. If no card/account information is present, no further sessions will be conducted until the outstanding payment is received. Additionally, reserved time slots may be lost if payment is not made in a timely manner.
If you are unable to attend your MammaFit sessions due to a medical condition affecting you or your baby, please do let us know and we can look at extending your sessions for you. In circumstances of long term illness or injury, we are able to offer a full refund which is at the discretion of MammaFit.
Any sessions transferred will also be subject to the remaining time frame of the sessions when transferred over. Sessions can not be transferred for cash or refunded.
Safety is a top priority for both Mums and Babies in our sessions. Therefore, if your little one is mobile and your MammaFit trainer has any concerns about their safety and the safety of other babies, they reserve the right to request that you secure your little one in their pushchair for the remainder of the session.
As Trainers and Mummies, we will do our upmost to look after your little ones to make sure that you get the most out of your session. However, you child is your full responsibility throughout the duration of every MammaFit session.
REGISTERED PROGRAMS/PRE PAID CLASSES
You have a right to cancel any class/ appointment that you have booked and can do so up to 2 hour before the class/ appointment start time as we understand that sometimes due to unforeseen circumstances you are unable to attend. We all know that baby’s can be very unpredictable at times!
However if you do not cancel, do not make contact with MammaFit before the class/ appointment start time to let us know that you are unable to attend and do not show up, you will be charged the nominated amount for the class/ appointment as there are other Mums and Baby’s who may miss out on a place if the class is showing full.
Neither party shall be liable for any failure to perform or delay in the performance of its obligations to the extent that such failure or delay is caused by any cause or circumstance beyond its reasonable control (which shall include, but not be limited to, interruption or failure of the Internet or of any network, telecommunications, power supply or infrastructure, or any provider of any of the foregoing).
THIRD PARTY CONTENT AND SERVICES
Your access to the Services may be dependent on third party services (such as Internet and mobile telephone services). MammaFit is not responsible for such services or the results of any failure or delay in such services.
Furthermore, the Services may contain third party created content and links to third party web sites or services. MammaFit is not responsible for such content, web sites or services or for any goods or services offered through or in connection with such content, web sites or services.
You must not, without the prior written consent of MammaFit, disclose to any third party any information (whether oral or written or in visual, electronic or tangible form) relating to MammaFit that could be considered confidential nor use any such information for any other purpose than the performance or enforcement of this Agreement. Such obligation of confidentiality shall continue in effect until two years after termination of this Agreement.
Each party shall ensure that its employees, officers, representatives or advisers to whom it discloses the other party's confidential information comply with this Clause 13.
Notices relating to this Agreement shall be made in writing. Notices to MammaFit shall be sent by e-mail to MammaFit at info@MammaFit.
Notices to you will be sent to your registered postal or e-mail address or to such postal or e-mail address which you have notified or used in communication with MammaFit
MammaFit reserves the right to change these Terms and the fees for the Services, in whole or in part, at any time. Such changes shall become effective one month after notice thereof is sent to you.
TRANSFER OF THE SERVICES
MammaFit may fully or partially transfer the Services to another company. All rights and obligations between you and MammaFit with regard to the Services (including the Agreement) will then apply between you and the company that takes over the Services.
GOVERNING LAW AND DISPUTES
This Agreement shall be governed by, and construed in accordance with, English law, and each party irrevocably submits to the non-exclusive jurisdiction of the English courts, without prejudice to each party’s right to seek injunctive relief in any court of
HEALTH AND AWARENESS
Please consult with your doctor prior to starting any of our exercise programmes.
If at any point during any exercise you start to feel faint, dizzy or nauseous please stop immediately.
You are responsible for exercising within your limits.
If you are a new mum, you must please take special care and don’t push yourself to exhaustion.
Make sure you stay hydrated and take breaks whenever you feel it necessary.
